WHMIS — Have You Been Solicited?

 
The National Office of WHMIS (NOW), several other government authorities and police departments have received numerous complaints from employers across Canada regarding aggressive and dubious solicitation from individuals attempting to sell them their “e-learning” WHMIS education product.
 
In many cases, employers have advised NOW that the sales representative has advised them that he/she is acting on behalf of NOW and/or a provincial government agency. Such solicitors have often inferred that should the employer decline their service, they could face considerable financial penalties.
 
Neither the National Office of WHMIS nor any government authority has engaged non government personnel to act on their behalf nor adopted a policy whereby an employer would be compelled to hire the company that contacted them to enable the employer to meet their legal obligations to provide their workers with WHMIS education and workplace specific training in respect of WHMIS “controlled products.”
